Business Interruption and Supreme Court Verdict

On 15th January 2021, the Supreme Court delivered its judgment on the Financial Conduct Authority’s (FCA) business interruption test case. The Supreme Court’s judgement is complex and is still to be clarified in a set of declarations.

We understand that many businesses will be hopeful of a successful claim as a result of this judgment.

However, many policy wordings (including Zurich’s Practice Insurance arranged through us) were not in scope of the court proceedings; as they had already been deemed to be clear, regarding Covid-19 not being covered. We therefore do not anticipate any changes in advice at this time. For more information, please see the guidance we provided in October 2020.

We are seeking clarification from relevant insurers and will contact any policyholders if they are affected.
